In 2014, a judge in U.S. District Court, District of Maryland, denied in part and granted in part Aargon Agency’s motion to dismiss Lipscomb v. Aargon Agency for alleged violations of the Fair Debt Collection Practices Act, the Telephone Consumer Protection Act, and privacy legislation. According to the judge’s conclusion, Aargon robocalled the customer’s cell phone in an effort to collect a hospital debt. Ms. Lipscomb told Aargon collections three unique times to quit calling her on her mobile phone. The judge judgment dismissed Ms. Lipscomb’s claim that Aargon Agency hauled a debt to another party, but allowed the case to proceed on the claims of FDCPA debt collection harassment and TCPA robocalling following revoking approval.
The Fair Debt Collection Practices Act (FDCPA) was enacted by Congress so as to protect consumers from predatory debt collectors. It sets down certain laws and guidelines that each and every debt collector — such as Aargon Agency debt collectors — must follow.
