Alfredo Sanchez v. American Airlines Workers

In the case of Alfredo Sanchez v. American Airlines Workers, the claimant filed a Petition for Benefits for an appointment with Dr. Alejandro Badia. Dr. Badia declined the E/C’s request to treat the Claimant so the E/C filed a response to the PFB denying authorization of a follow-up appointment with Dr. Badia. Ultimately, the E/C agreed to authorize a replacement doctor. The JCC found Claimant to be entitled to attorney’s fees from the E/C since the E/C agreed to authorize a second doctor and provide the follow-up care as needed based on Stromas v. Champion Int’l, 828 So. 2d 495 (Fla. 1st DCA 2002).

JCC AWARDED claimant’s attorney fees of $7,515.00 for 27.70 hours.
