Christine Celentano v. Praxair Distribution Southeast and Broadspire Services, Inc.

In Christine Celentano v. Praxair Distribution Southeast and Broadspire Services, Inc. Claimant argues that she is entitled to penalties and interest on late indemnity payments. E/C argues that while the payments were late they overpaid so no penalties and interest are due. The E/C contends that there was an overpayment because they did not apportion PTD benefits. The JCC found that the EC has not established that apportionment is appropriate therefore Claimant is entitled to penalties and interest. Petition GRANTED.
