In Ginette Brown v. Opis Coquina Center and Gallagher Basset Services, Inc. the Claimant was injured when she attempted to prevent a fall and diagnosed with neck sprain/strain. EC authorized treatment which showed Claimant had a disc herniation and stenosis. Claimant was then placed at MMI. Claimant then requested a one-time change of physician which was authorized. The authorized physician then stated that Claimant had the option of cervical discectomy and fusion. Claimant petitioned for surgery and EC denied it. JCC found that EC waived the right to deny compensability of the condition requiring surgery under the 120-day rule. Authorization of surgery GRANTED.
