Hanser Ramirez v. Publix Super Markets

The case of Hanser Ramirez v. Publix Super Markets, Inc. and Risk Management arose when the claimant suffered an injury with no pre-existing conditions at his place of employment. Having exited his vehicle in the parking lot of his workplace, he injured his foot. This closely aligned with the case of Ross v. Charlotte County Pub. Sch., in which the workplace was proven to be of higher risk for injury than the claimant’s personal life. Seeing as the risk was higher at the workplace, and the E/C supervisor testified that the claimant was a trustworthy employee, the JCC decided in favor of the claimant.

Compensation GRANTED; Jurisdiction RESERVED for further hearings
