In Jose Cepeda v. Intrepid Realty Group, LLC and None the Claimant sustained an on-the-job accident while working for employer as a handyman. The Employer is uninsured and failed to appear for deposition after being ordered to do so. Which resulted in a sanction for employers defenses to be struck. Employer was represented by counsel who appeared a final hearing but was only permitted to present legal argument as to whether claimant met his burden of proof. Claimant presented claims for compensability and benefits. The JCC found that the accident is compensable but Claimant failed to report his wages to the IRS which resulted in claimant failing to establish AWW. Claim for indemnity DENIED.
