Joseph Dejoie suffered an accident in 2020 that was compensated and authorized. The case of Joseph Dejoie v. Broward Health North and North Broward Hospital District focused on the claimant’s contention that their Group Term Life Insurance (GTL) should be included in the Average Weekly Wage (AWW).
Following Florida Statute 440.14(1)(a), the claimant provided proof that their AWW should have a higher-payout, by providing their previous pay stubs as evidence.
The claimant also argued for entitlement to penalties and interest for the first period of their impairment benefits. The claims adjuster for the E/C proved their defense that they followed Florida Statute 440.15(3)(a) and paid for the impairment benefits within 14 days.
