In Marianela Laporte v. Baptist Health South Florida, Inc./Miami Cancer Institute at Baptist Health, Inc. and Johns Eastern Company, Inc./Baptist Hospital of Miami the Claimant filed a Petition for Benefits but did not serve the petition for benefits on the Employer or Carrier. Claimant only served the PFB on E/C’s counsel. E/C argues that Claimant is required to serve a copy of the PFB by certified mail to the employer and carrier. Claimant argues that the PFB is only required to be served to E/C’s counsel or the employer and carrier. JCC found that the statute requires the claimant to serve a PFB on the employer and carrier. Petition DISMISSED without prejudice.
