In Matthew Casey v. City of Hallandale Beach Police Department and Preferred Government Claims Solutions, the E/C previously offered compensation for claimant. The claimant was diagnosed with PTSD, which as an occupational disease, had multiple dates of accident.
Seeing as PTSD followed the original accident, newly enacted Florida Statute 112.1815(5)(a) applied, entitling the claimant to indemnity benefits based on Orange County Fire Rescue v. Jones and Pasco County Sheriff’s Office v. Shaffer. The claimant informed the employer of his injury within 90 days of manifestation of his PTSD, in accordance with Florida Statute 112.1815(5).
Based on Lalonde v. Checker’s Drive-In Restaurants, Inc., the claimant proved that he was restricted from adequately performing his prior job, and was also awarded TPD benefits that would be handled administratively.
