Michael Crisp v. Areas USA, Inc. and Corvel Corporation

In Michael Crisp v. Areas USA, Inc. and Corvel Corporation the Claimant sustained a compensable industrial accident in a motor vehicle accident. The Claimant also filed an uninsured motorist lawsuit against the other driver. The Claimant then reached a settlement agreement for the uninsured motorist lawsuit for the sum of $275,000.00 which included a General Release. Meanwhile, the Claimant continued to seek workers’ compensation benefits. E/C filed a Notice of Denial asserting further benefits were denied due to the General Release. The Claimant argued that the General Release was ambiguous to any work comp matter. The JCC found the general release to be unambiguous. Petitions for benefits DISMISSED.
