In Oscar L. Escobar Martinez v. Vanguard Hammer Property Renovations Inc. and State National Insurance Company the Claimant slipped and fell off of a roof. The Claimant states that he was on the roof for a roofing job but the stucco contractor stated that the reason he was on the roof was to provide an estimate. The Claimant brought the claim against the roofing contractor. The roofing contractor also stated that there was no work being performed and that Claimant was on the roof to provide an estimate. The JCC found that the claimant the the employer did not have a contract for a roofing job. The JCC also found that Claimant and employer have credibility issues with their testimony. Petition DENIED.
