Paul Manganello v. West World Telecom Corporation and Travelers Property Casualty

In Paul Manganello v. West World Telecom Corporation and Travelers Property Casualty the Claimant was unrepresented, presented no evidence to support his allegation that he was in the course and scope of employment at the time of his accident and presented no medical evidence that he sustained injuries in the accident. Entitlement to indemnity benefits and medical care is predicated on proof of an injury arising out of the course and scope of employment. Furthermore, the Claimant’s Petition for Benefits was not timely filed and is barred since it was filed more than two years of the injury. The JCC found that the claims for Indemnity benefits, medical care and Compensability are DENIED.
