In Robert Koehler v. Morgan Auto Group, LLC and Bridgefield Employers Insurance Company a final compensation order was entered denying compensability and denying all benefits. Claimant does not dispute that costs were incurred but does not agree that all of them are taxable. The total amount of costs E/C seek to recover is $7,899.24. $5,155.00 paid for surveillance was the most significant cost discussed. The surveillance was not placed into evidence or otherwise used at the final hearing (except for two screen shots) but the JCC looked to determine whether the surveillance was reasonable or necessary to defend the claim. The JCC did not find the surveillance was reasonable or necessary to defend the claim. Taxable costs were ASSESSED against claimant in the same of $2,444.24.
