Tanya A. Starks v. Hillsborough County School Board and Broadspire

Tanya A. Starks v. Hillsborough County School Board and Broadspire E/C filed a Motion to Dismiss Claimant’s PFB filed one week after the JCC awarded E/C taxable costs of $5,370.80. Claimant has not paid any costs to E/C and therefore failed to comply with the order. According to the statute, if an employee fails to comply with an order of a JCC within 10 days, the JCC may dismiss the claim until the employee complies with the order. Here, the Claimant failed to make any payments. The claimant argued that she was not aware of the order and that she cannot afford to pay anything. The E/C showed evidence that claimant is able to pay and the JCC stated that Claimant’s lack of knowledge of the order is irrelevant and not an excuse. The JCC GRANTED the Motion to Dismiss.
