Teresa Miller v. Western Express Transportation was a bifurcated issue regarding a truck driver’s accident in Tennessee. The truck driver (claimant) contended they had been recruited in Florida, but the employer argued that the contract was finalized in Tennessee. Considering this, the employer claimed that the case was not under Florida’s jurisdiction.
In examining the evidence, the JCC found that although the claimant was from Florida, the finalization of the contract occurred in Tennessee. Per the Florida Statute, a contract is formed where the last act of the agreement takes place.
The claimant was unable to provide substantial evidence to uphold her claim that the employment contract was set in Florida. The petition was denied and dismissed as it was determined not to be a Florida issue.
