Thadiss Gregory v. Bennett Auto and Travelers Indemnity Company/Gulf Insurance Group

Thadiss Gregory v. Bennett Auto and Travelers Indemnity Company/Gulf Insurance Group Claimant underwent compensable neck surgery in June 2021. Prior to the neck surgery the claimant also underwent compensable knee surgery in 2019. This claim concerned TTD benefits for the 14-month period between claimant’s release from restrictions from the knee surgery and the performance of the neck surgery. While claimant testified he “believed” he was totally disabled during the period in question, the JCC noted the same must be supported by credible medical evidence. In this instance, the JCC did not find the doctor’s opinion on which claimant relied was reliable due to the physician’s lack of knowledge regarding claimant’s overall condition. Petition for TTD benefits DENIED.
