In the Florida workers’ compensation case of Victor Cabrera v. Kablelink Communications, the claimant appealed to the JCC’s prior decision to deny their benefits. The JCC claimed that since the claimant was an independent contractor, they did not qualify for workers’ comp benefits. The claimant argued that they were legally considered an employee due to their installation of a residential cable.
Regardless of the claimant’s work on the cable in the building, it was not enough evidence to prove that the claimant was working with the construction industry when the injury occurred.
