Adrian O’Neal v. City of Jacksonville and City of Jacksonville Risk Management

In Adrian O’Neal v. City of Jacksonville and City of Jacksonville Risk Management the JCC was directed to consider and address “the trigger theory in view of the exercise-related medical evidence” pursuant to instruction from the First DCA. The JCC considered the medical evidence and the evidence relating to the claimant’s activities prior to the accident. After review of the evidence presented, the JCC found that it does not reveal any medical evidence relating to the trigger theory and the E/C has not met its burden of proof to establish by the greater weight of the evidence the existence of a non-occupational cause of the trigger. First DCA AFFIRMED the decision per curiam.
