In Desiree Samson v. DSK Group Inc. II/D.A.V. Electric LLC and Zurich Services Corporation the Claimant filed a petition for benefits requesting an orthopedic surgeon for cervical pain located in the State of Washington. The E/C asserts that the JCC does not have jurisdiction over this medical issue as the claimant failed to properly exhaust the managed care grievance procedures prior to filing the petition. The JCC found there was lack of jurisdiction. Claim for out of state orthopedic physician DENIED for lack of jurisdiction.
